Beta Terms of Service
These terms cover PRISM’s private beta for wealth advisors. They will be revised before PRISM launches commercially.
1. Who we are
PRISM is operated by Mitchell Wierstra, an individual in Alberta, Canada, doing business as PRISM ("PRISM", "we", "us"). PRISM is not yet a separate legal entity; these terms will be updated when the business incorporates. Contact: prismportfolioanalytics@gmail.com.
2. Who PRISM is for
PRISM is a portfolio-analysis tool for wealth advisors, offered in a private beta by invitation. By creating an account or using PRISM, you agree to these terms and to the Beta Privacy Policy. If you use PRISM on behalf of a firm, you confirm you are allowed to do so.
3. Anonymized data only
If you upload a screenshot, crop out names and account numbers first: screenshots are sent to our AI provider to read the holdings (see the Privacy Policy). You are responsible for having the right to use any portfolio information you upload.
4. Not financial advice
PRISM is an analytical tool. It does not give investment, tax or legal advice, and nothing it shows is a recommendation. You are responsible for any recommendation you make to a client or prospect, and for meeting your own regulatory and professional obligations. Check important figures before relying on them.
5. The data may be incomplete or wrong
PRISM’s results depend on fund holdings, fees and classifications from public filings and third-party data, which can be out of date, incomplete or wrong. PRISM shows some known gaps (for example, holdings it could not look through), but it cannot catch every error. AI-generated text can also be inaccurate.
6. Beta, “as is”
PRISM is a beta. It is provided “as is” and “as available”, without warranties of any kind, including accuracy, availability or fitness for a particular purpose. Features can change, break or be removed. We may change, suspend or end the beta, or your access to it, at any time, with or without notice.
7. Acceptable use
Don’t share your login, try to access other users’ data, overload or attack the service, copy or resell PRISM’s data or software, or use PRISM for anything unlawful.
8. Your content and ours
You keep the rights to what you upload. You give us permission to process it to run PRISM for you, as described in the Privacy Policy. PRISM’s software, data and reports belong to us. If you send us feedback, we may use it without any obligation to you.
9. Limits on liability
To the extent the law allows, we are not liable for indirect, incidental or consequential losses, or for lost profits, clients or data, arising from your use of PRISM. Our total liability for any claim relating to PRISM is limited to the greater of CA$100 and the fees you paid us for PRISM in the 12 months before the claim. Some laws do not allow these limits, so they apply only as far as the law permits.
10. Ending
You can stop using PRISM at any time and ask us to delete your data (see the Privacy Policy). Sections 4, 5, 6, 8, 9 and 11 continue to apply after your access ends.
11. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Disputes will be heard by the courts of Alberta.
12. Changes
We may update these terms. If we make material changes, we will tell you by email or in PRISM before they apply. Using PRISM after that means you accept the updated terms.
